| Landlord Harrassment? |

| My mother lives in Alamosa County, Colorado and her husband recently lost his job, which put them a week or so behind on rent. She notified the landlord that the rent would be late, as she was borrowing it and waiting for it to arrive, and the landlord's wife said that was fine, and thanked her for letting her know.
This evening the landlord and his wife sped up to my mother's house and screeched into the driveway, which was alarming enough, and then banged on her door. My mom opened it, and not expecting a problem, moved aside to let them in. The landlord pushed through and walked straight over to my mother's television and turned it off and proceeded to yell loudly at my mother, over and over again, about the late rent and repeated himself, always yelling, over and over again no matter what she said. It drove her to tears, and she's afraid of doing anything about it because she doesn't want any trouble.
But what I'd like to know is: does the landlord have legal right to come into the house, manipulate her personal belongings without permission, and yell and scream at her in the home? Or would this by legal definition be considered harrassment?
Any help is appreciated - thanks.

| Tonya - No, he cannot enter like that unless he was allowed or invited in by the tenant. I'd suggest that if he comes again that she not allow him in and if he comes in anyway, ask him to leave or you will call the police. When he stays - CALL the police. This LL sounds like a real peach. Advise her to consider looking for another place without a jerk for a LL. |

| by the way, all of this after hes tried to evict me but i had my lawyer get the case dismissed 2 times, i think this is retalliation, isnt waht he did "intrusion or invasion of privacy"? can he come in a take pictures of minor children especially if i ask then insist he stops? |

| Where do you live? What does your lease say about the Landlords entering the premises..We state in our leases that "we reserve the right to enter the home with a 24-hour notice to inspect or do repairs, unless it is an emergency, then we we can enter without a notice. Also we make our tenants carry renters insurance, for that incedents just like yours...
He may have had the right to enter, however he did not have the right to slander you or your family. |

| does my landlord have the right to enter my premises at any time without prior notice.since we have changed ownership i have had five cases where they have entered without my permission and without an emergency situation. today i cama home to find my loft windows had been replaced,,my blinds had been removed and discarded because i cannot find them anywhere, and no one gave me any notice that they would be entering my apartment today |

| My landlord does not fix things in a timely manner. I have asked to have the vents in my apartment cleaned for over a year and he just keeps blowing me off. Does he have to clean this? He also enters my apartment whenever he wants without notice or with an hour notice. If I do not answer the door soon enough he just marches in. Is this legal. Is there someone I can go to that can answer these questions. |

| In most states, the landlord does not have the right to enter without notice except for emergencies. Some states require 48 hours, some 24 hours, some simply require "reasonable" notice, which judges may take to mean 12 hours, 24 hours, or whatever other number he wishes. However, many states will allow a lesser time than in the law if stated in the lease agreement, so read your lease to see if such is the case.
Your permission is not required, it is only required that you be provided notice per your state's law. In other words, if the landlord tells you that his workers will be installing windows on a certain date more than the required period, they may do so whether or not you gave permission or are at home on that date. Regarding the missing blinds, keep in mind that you may not have had the right to install blinds without the landlord's permission. If the landlord installed them, perhaps he will be replacing them.
You should discuss the issues with the landlord. Communication is just as much the responsibility of the tenant as of the landlord.

| The landlord may not be required to clean the vents. You can call your local housing agency and ask if that is considered a habitability issue. Check the law of your state regarding the period required for entry notice, if it is covered in your state. If your state covers the issue, send a copy of that section of the law to the landlord along with a written request that he follow the law in the future. |

| My landlord knew that I was a victom of a crime and my husband left me with the rent money. So I couldn't pay rent. Does he have the right to write me letters(2) stating that I get counseling and a job(which I have one but am injured) as well as stating that he has neighbors watching me ? |
